Who we are and what these terms cover
Moving Atoms is run by MovingAtoms Inc., San Francisco, California ("Moving Atoms", "we", "us"). These terms cover the website movingatoms.ai and the Moving Atoms app at movingatoms.ai/app (together, "the service"). By creating an account, uploading a file or buying credits you agree to them. If you use the service for a company, you agree for that company and confirm you can.
What the service does
You upload a scan of a real place. Our software converts it, an AI agent builds a model of it in conversation with you, and you download the files you asked for (for example Revit, IFC, USD or GLB).
- The work is done by an AI agent. It measures your scan, checks its model against it and tells you what it inferred rather than measured. It can still make mistakes.
- Check before you build. Review the model and its reported deviations before you rely on it for fabrication, construction, safety-critical or legal decisions. The service is not a certified survey or professional engineering service.
- Estimates are estimates. Before you start, we estimate the credits and time a job will use. The estimate includes one round of changes. Actual use can be lower or higher; the agent tells you early if it expects to run well past it.
- The service changes. We improve it often and may change or remove features. We'll tell you before a change that takes away something you rely on.
Your account
You sign in with a one-time code sent to your email. Keep that inbox secure: anyone who can read it can sign in as you. Give us an email address you control, and tell us at [email protected] if you think someone else has used your account. You must be at least 16, or the age of digital consent where you live if that is higher.
Projects are private to the people you add to them. Owners can invite others as editors or viewers and are responsible for whom they invite.
Credits and payment
- What credits are. Credits pay for the work done on your projects. One credit is one US dollar. Your balance is shown in the app, with every charge in your account's ledger.
- Billed at cost. Work is charged in credits at what it costs us to run: the AI model use and computing each step takes, with no markup.
- Starting credits. New accounts may get a small number of free credits to start with. They have no cash value and can't be exchanged or refunded.
- Buying credits. You buy credits in packs through Stripe Checkout. Before a job we suggest a top-up of about three times what it is expected to use, so the work can't run short; you can choose another amount. The pack and its price in US dollars are shown before you pay, and taxes are added where they apply. We never see or store your card number; Stripe does.
- How credits are used. Credits are charged as the agent works: each step it takes is metered and debited from your balance as it happens. Converting your uploads, saving versions and downloading files don't use credits.
- Running out. When your balance reaches zero, work stops cleanly and waits. Nothing is charged to your card automatically; add credits and it carries on.
- Unused credits stay in your account for later work. More in our credits and refunds policy.
- Credits belong to your account and can't be sold or transferred to another account.
Open point, to be decided before this page takes effect: whether unused purchased credits can be refunded, and if so within what time and how.
Your scans and your models
- You own what you upload (scans, drawings, notes, messages) and the models and files made for you. You can download them at any time while your account is open.
- What you let us do with it. You give us permission to store, copy, process and display your content only to run the service for you: converting scans, running the agent, producing files, keeping backups and helping you when you ask. This permission ends when your content is deleted, except for copies we must keep by law.
- Your right to upload. Only upload content you have the right to share with us, for example scans of sites you are allowed to scan and to have modelled.
- No training on your data. We don't use your scans, models or messages to train AI models, ours or anyone else's, without asking you first. We may use numbers about jobs (such as their size, duration and credits used) to improve our estimates.
- How we handle personal and project data is in our privacy policy.
Acceptable use
Don't use the service to break the law or anyone's rights; upload malware or content you have no right to; try to reach other customers' data, our systems or the agent's environment beyond what the app offers; overload or disrupt the service; resell it as your own; or use it to build a competing product. We may suspend an account that does, and we'll tell you why unless the law or safety prevents it.
Ending
You can stop using the service and ask us to close your account at any time by emailing [email protected]. What happens to unused purchased credits when you close your account is in the credits and refunds policy. We may close accounts that break these terms, or end the service with at least 30 days' notice, in which case we refund all unused purchased credits.
Warranties and liability
We work hard to make models accurate and the service reliable, and we fix our mistakes. Apart from that, the service is provided "as is", without warranties of any kind, to the extent the law allows. We are not liable for indirect or consequential losses (such as lost profits, delays or the cost of rework) arising from the service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$100. Nothing in these terms limits liability that can't be limited by law.
Law and changes
These terms are governed by the laws of the State of California, and disputes go to the courts of San Francisco County, unless the law where you live gives you other rights. If we change these terms in a way that matters, we'll email you and post the change here at least 14 days before it takes effect. Questions: [email protected].
